Terms of Service

Draft notice: this is a working draft written for a UK/EU-facing service and is meant as a strong starting point, not finished legal advice. Have a qualified lawyer review it, particularly the billing, withdrawal-right, and liability sections, before this goes live and starts taking real payments.

1. Who we are and what these Terms cover

These Terms of Service ("Terms") govern your access to and use of BotGenie (the "Service"), operated by BotGenie ("we", "us", "our"). By creating an account, subscribing to a plan, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service lets you describe a Discord bot in natural language and receive AI-generated code implementing that description, which you may download or have us host on your behalf.

2. Eligibility

You must be at least 16 years old (or the minimum age of digital consent in your country of residence, if higher) to create an account. If you are under the age required to consent on your own behalf, a parent or legal guardian must accept these Terms on your behalf. You must also meet Discord's own minimum age requirements to create or operate a Discord bot.

3. Accounts

  • An account is required to use any plan, including the Free plan. You may sign in with a supported third-party provider (currently Google or Discord).
  • You are responsible for maintaining the security of your account and for all activity that occurs under it.
  • You must provide accurate information and keep it up to date. We may suspend or terminate accounts that provide false information or are used to circumvent plan limits (e.g. creating multiple free accounts to bypass generation limits).

4. Plans, billing, and cancellation

Current plans and what they include are listed on our Pricing page and summarized here:

  • Free: $0.00/month, 5 generations per month, final code priced at $5.99, hosting at $3.99/month.
  • Basic: $3.99/month, 25 generations per day, final code priced at $4.99, hosting at $3.59/month.
  • Pro: $5.99/month, 50 generations per day, final code priced at $3.49, hosting at $3.39/month.
  • Ultra: $7.99/month, 150 generations per day, final code priced at $1.99, hosting at $3.19/month.

Recurring billing. Paid plans renew automatically each month until cancelled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period, and you retain access until then.

Price changes. We may change plan prices with at least 30 days' notice. Continued use after a price change takes effect constitutes acceptance of the new price; you may cancel before it takes effect if you don't agree.

Right of withdrawal (EU/UK consumers). Under EU and UK consumer law, you normally have 14 days to withdraw from a distance contract for digital content without giving a reason. Because generations, hosting, and the final code file are digital content/services that begin performing immediately at your request, by starting a paid plan or purchasing bot code you expressly request immediate performance and acknowledge that you lose the right of withdrawal once performance has begun (i.e. once you use a generation, download code, or hosting starts). Where the Service has not yet been performed, the standard 14-day withdrawal right applies.

Refunds. Outside of the withdrawal right above, payments are generally non-refundable, except where required by law or at our discretion for billing errors or service failures on our part.

5. Generation limits and plan gating

Each plan includes a set number of AI generations per the period stated on that plan. Requests that exceed your plan's supported complexity level will be declined with an in-product explanation and, where applicable, a suggested upgrade. This does not consume a generation from your allowance. We may adjust complexity gating and generation allowances over time to keep the Service sustainable; material reductions to a paid plan's allowance will be communicated in advance.

6. Acceptable use and content policy

You may not use the Service to generate, request, or deploy anything that:

  • Contains or promotes hate speech, slurs, or discriminatory content targeting race, ethnicity, religion, disability, sexual orientation, gender identity, or other protected characteristics.
  • Violates Discord's Terms of Service or Community Guidelines, including self-bots, user-token automation, token grabbers, spam/raid tooling, or anything designed to abuse Discord's platform or rate limits.
  • Is malware, or is designed to gain unauthorized access to systems or accounts you don't own or have permission to test.
  • Infringes a third party's intellectual property rights.
  • Is illegal under the laws applicable to you or to us.

General profanity and non-hateful adult (NSFW) content are permitted, consistent with Discord's own platform rules on age-gated content. It is your responsibility to configure any NSFW functionality in line with Discord's requirements for age-restricted channels and content.

We use automated and manual review to enforce this policy. Violating it may result in a declined request, suspension, or termination of your account, at our discretion and without refund of amounts already paid for the billing period in which the violation occurred.

7. Ownership of generated code

Once you purchase the final code for a bot, you own that specific generated code and may use, modify, host, or distribute it as you wish, subject to Discord's own terms and applicable law. We retain no exclusivity over code generated for you, though we may reuse general techniques, patterns, and non-identifying learnings to improve the Service. We are not responsible for ensuring the generated code is free of defects; see Section 9 (Disclaimers).

8. Hosting

Hosting is a separate product from generation and the code purchase. It is billed monthly per the Pricing page (a base price with a plan-based discount), continues until cancelled, and is subject to reasonable fair-use limits on compute and bandwidth. We may suspend a hosted bot that violates Section 6, that is abusing shared infrastructure, or for non-payment, with notice where practicable. You remain responsible for your bot's behavior in any Discord server it joins, even while we host it.

No responsibility for the bot's own code. Hosting means we keep the process running; it does not mean we wrote, reviewed, or are responsible for what that code does. This applies whether the code was generated by BotGenie or uploaded by you directly. We are not liable for errors, bugs, crashes, data loss, or any other consequence caused by the bot's own code, including code you provide yourself through the upload feature. If uploaded code violates Section 6 (acceptable use) or Discord's own Terms of Service, we may suspend hosting without refund for the affected period.

Promo codes. Promo codes may reduce the price of a specific purchase or hosting subscription at checkout. They are single-use per redemption unless stated otherwise, may have expiry dates or usage limits, and we may end or change any promo code at any time. Applying a promo code does not change any other term in this agreement.

9. Disclaimers

The Service, including all AI-generated code, is provided "as is" and "as available." AI-generated code may contain errors, bugs, or unintended behavior. We do not warrant that generated code will be fault-free, secure, or fit for a particular purpose. You are responsible for reviewing and testing any generated code, particularly before using it in a production Discord server. Nothing in this section excludes liability that cannot be excluded under UK or EU law (for example, liability for death or personal injury caused by negligence, or for fraud).

10. Limitation of liability

To the maximum extent permitted by law, our total liability to you arising out of or relating to the Service is limited to the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential losses, including loss of data, loss of Discord server access, or lost profits, arising from your use of generated code or hosting.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access for breach of these Terms, non-payment, or extended inactivity, with notice where reasonably practicable. Sections that by their nature should survive termination (ownership, disclaimers, liability, governing law) continue to apply.

12. Data protection

We process personal data (such as your account details and usage data) in accordance with applicable data protection law, including the UK GDPR and EU GDPR where applicable. Full detail on what we collect, why, and your rights (access, correction, deletion, portability) belongs in a dedicated Privacy Policy. Add one before launch; this Terms document alone is not sufficient for GDPR compliance.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified in-product or by email at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance.

14. Governing law and disputes

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. If you are a consumer resident elsewhere in the EU, mandatory consumer protections of your country of residence may also apply and are not affected by this clause. Courts of England and Wales have non-exclusive jurisdiction over disputes arising from these Terms, without prejudice to your right to bring proceedings in your country of residence where applicable law grants you that right.
